www.straightaheadfilms.com (“The Website”) is owned and operated by Straight Ahead Films LLC (“LLC”). These terms and conditions govern your access to and use of the Website, including any content, functionality, and services offered on or through the Website.  All films, images and other media on the Website are and shall remain the intellectual and copyrighted property of the LLC, and is provided to users only in the form of a license to use such content for the purposes described herein.  The LLC retains proprietary rights over such content as protected by the copyright laws of the United States, including (but not limited to) 17 U.S.C. Sec. 201.

By using the Website, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you must not access or use the Website.

The Website provides access to films and other media (“content”) specifically designed for use by trained counselors and healthcare professionals in the context of treating alcohol use disorder ("AUD"). The content on this Website is intended for educational and informational purposes only, and is not a substitute for professional medical advice, diagnosis, or treatment.  The Website makes no representations or warranties, express or implied, as to the effectiveness of the content to be so utilized, and does not guarantee results or recovery from AUD under any circumstances.

2. Not a Substitute for Professional Care

The content, including but not limited to the films and other media referenced above, provided on Website is intended to be used in a clinical setting under the guidance of trained healthcare professionals. LLC and its operators are not healthcare providers, and the content available on the Website is not intended to diagnose, treat, or prevent any medical condition.  LLC and its operators in no way intend to directly or indirectly intervene or participate  in the diagnosis and treatment of individuals who have sought care from trained counselors and healthcare professionals.

3. No Liability for Misuse

The Website, and the content contained therein, is intended for use by trained healthcare professionals in clinical settings. If content is utilized to treat an individual, or a viewer uses the content independently outside of this intended context, LLC assumes no liability for any consequences, including but not limited to:

  • Emotional distress or psychological harm;

  • Worsening of symptoms related to AUD or any other health conditions and/or disorder;

  • Any form of self-harm, whether intentional or accidental;

  • Personal injury, emotional distress or psychological harm to any third-parties not involved in the treatment or diagnosis of the viewer 

         

By accessing and/or using the Website, you acknowledge and agree that LLC is not liable for any adverse outcomes resulting from the improper use of the Website’s content, including but not limited to any use outside a clinical context or without professional supervision.

4. Disclaimer of Medical and Mental Health Liability

The Website provides content designed to encourage the treatment of AUD, but it is not responsible for how the content is interpreted or applied.

No Warranties: The content is provided "as is," without any guarantees, representations, or warranties of any kind.  LLC does not make any guarantees about the content’s effectiveness or outcomes of using the content, nor does LLC  guarantee that the content will prevent harm, relapse, or any other negative outcome.

No Assumption of Duty: Viewing or using the content on this Website does not create any form of legal or professional relationship between LLC and the viewer. No duty of care is assumed by LLC or its members. Under no circumstances will the use of the Website or its content constitute the “launching of an instrument or force of harm” by the LLC and creating any duty to viewers for adverse results; or induce detrimental reliance by any viewer upon the films and media offered as content; or displace in any degree or any way the duties owed by trained counselors and healthcare providers to their subjects.

 

5. Limitation of Liability

In no event shall LLC, its members, successors, assigns, or agents be liable for any direct or indirect, consequential, incidental, special, or punitive damages, including but not limited to personal injury, pain and suffering, emotional distress, or harm (including suicide or other self-harm), arising out of or in connection with the use or inability to use the Website or its content.  This limitation of liability applies to viewers of content or their Estates/survivors, and or any third parties who may not have been directly involved in the treatment and care of viewers.  These Limitations of Liability apply to any direct claims attempted to be made against the LLC, or any attempt to impose third-party liability against the LLC by subscribers, users, or persons effected by the misuse of content.

6. Indemnification

You agree to indemnify and hold harmless LLC, its members, successors, assigns, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of your use of the Website, including but not limited to any harm, injury, or other damages resulting from the misuse or misinterpretation of the content. 

Furthermore, LLC will not be responsible, or assume any liability, for any negligence or intentional misuse of the Website’s content by a healthcare professional or any other user accessing the Website for any purpose, clinical or otherwise.

By using the Website, you agree to use the content only as intended and acknowledge the risks associated with using the Website’s content outside of professional settings. You acknowledge that such content is not appropriate for unsupervised or self-guided therapeutic purposes, and agree to seek professional support when necessary.

Any controversy or claim arising out of or relating to the use of the Website or content shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.  If any part or subdivision of these Terms and Conditions are found to be void by any ruling of a court of competent authority, the remainder of the Terms and Conditions will survive and remain in full force and effect.
